1. Acceptance of Terms

Welcome to Passaver! By accessing or using our password management service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and Passaver. Please read them carefully.

2. Service Description

Passaver is a free, open-source password manager that provides:

  • Secure password storage with AES-256 encryption
  • Zero-knowledge architecture (we cannot access your passwords)
  • Client-side encryption (all encryption happens in your browser)
  • Cross-device synchronization of encrypted data
  • Password generation and security analysis

3. Eligibility

To use Passaver, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the service under applicable laws
  • Provide accurate and complete registration information

4. User Responsibilities

4.1 Account Security

⚠️ Critical: Master Password Responsibility

You are solely responsible for maintaining the confidentiality of your master password. If you lose your master password, we CANNOT recover your data. There is no "password reset" option due to our zero-knowledge architecture.

You agree to:

  • Create a strong, unique master password
  • Keep your master password confidential and secure
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized access
  • Accept full responsibility for all activities under your account

4.2 Acceptable Use

You agree NOT to:

  • Use the service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to our systems
  • Transmit malware, viruses, or harmful code
  • Reverse engineer, decompile, or disassemble the service
  • Use automated systems (bots, scrapers) without permission
  • Impersonate others or misrepresent your identity

5. Zero-Knowledge Architecture & Data Recovery

🔐 IMPORTANT: Understand Our Limitations

  • We CANNOT recover your passwords: Your master password is never transmitted to our servers. All encryption happens locally in your browser.
  • We CANNOT reset your master password: Unlike traditional services, there is no "forgot password" recovery option.
  • You are responsible for backup: We recommend securely backing up your master password offline (write it down and store it safely).
  • Data loss is permanent: If you forget your master password, your encrypted data becomes permanently inaccessible.

By using Passaver, you acknowledge and accept these limitations. This is a feature, not a bug – it ensures maximum security and privacy for your data.

6. Free Service & No Warranty

Passaver is provided free of charge and open source. As such:

  • The service is provided "AS IS" without warranties of any kind
  • We make no guarantees about availability, reliability, or uptime
  • We may modify or discontinue features at any time
  • We reserve the right to limit usage or terminate accounts for policy violations
  • No service level agreements (SLAs) are offered

7. Intellectual Property

7.1 Our Rights

Passaver's source code is licensed under an open-source license. The Passaver name, logo, and branding remain our intellectual property.

7.2 Your Data

You retain all rights to your data. We claim no ownership over your encrypted passwords or personal information. Your data belongs to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Passaver and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not responsible for data loss resulting from forgotten master passwords
  • We are not liable for damages arising from service interruptions, bugs, or security breaches
  • Our total liability shall not exceed $100 USD or the amount you paid us (which is $0 for free users)
  • We are not responsible for third-party services (Firebase/Google Cloud) failures

9. Indemnification

You agree to indemnify, defend, and hold harmless Passaver and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your negligent or wrongful conduct

10. Termination

10.1 By You

You may terminate your account at any time through your account settings. Upon termination, your data will be permanently deleted within 30 days.

10.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason with or without notice. We will make reasonable efforts to notify you before termination unless prohibited by law.

11. Data Export & Portability

You can export your encrypted data at any time through your account settings. We provide data in standard formats to ensure portability to other services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will:

  • Notify you of significant changes via email or in-app notification
  • Update the "Last Updated" date at the top of this page
  • Provide at least 30 days notice for material changes

Your continued use of Passaver after changes constitutes acceptance of the modified Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of this service shall be resolved through binding arbitration in accordance with the rules of the Vietnam International Arbitration Centre (VIAC), conducted in Hanoi, Vietnam, except where prohibited by law. Each party shall bear their own arbitration costs unless otherwise determined by the arbitrator.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Passaver concerning your use of the service, superseding any prior agreements.

16. Open Source License

Passaver's source code is available on GitHub under an open-source license. You are free to review, audit, and contribute to the codebase according to the terms of that license.

You specifically acknowledge that:

  • You understand the zero-knowledge architecture and its implications
  • You accept responsibility for your master password security
  • You understand that lost master passwords cannot be recovered
  • You accept the service "as is" with no warranties
